As of June 1, 2014, under the historic legislation the Religious Freedom-Marriage Act which made Illinois the 16th state to legalize same-sex marriage, married gay couples in Illinois receive the same treatment as heterosexual couples under the law. Illinois will also now recognize same-sex marriages from other states.
Along with all of the same treatment related to marriage, same sex-couples are also entitled to the same treatment when it comes to divorce, custody disputes and post-divorce proceedings. The governing body of law pertaining divorce and custody is the Illinois Marriage and Dissolution of Marriage Act.
Older couples, who have established careers and more assets that a younger couple may have, may especially want to consider entering into a pre-nuptial agreement. Also, if a couple is considering having children and reproductive technology or adoption may be involved, they will require legal counsel.
